*Legal Implications of Teachers Role in Pupils/Students Discipline*.
The teacher is expected to work within the ambit of the rules, regulations, laws or Acts that govern the practice of his/her profession. According to Teachers Registration Council of Nigeria (2005), teachers are bound to be liable for any acts or omissions that run contrary to professional standards or fall short of commonly held values, acceptable practices and norms. Thus, the teacher will be held liable and proceeded against for any act, omission or negligence that infringes on the rights of pupils/students.
Recent times, some private schools had witnessed teachers inflicting dangerous and hard punishments on pupils/students without minding or considering the legal implications. As a result of this act, Police officers had visited schools to arrest teachers at the instance of the child's parents. Also, parents had visited schools to harass and embarrass teachers for been cruel and hostile towards their children.
Though, the teacher is legally and professionally bound to exercise his/her powers and discharge his/her duties honestly, in good faith, with utmost care, diligence and skills.
*The discipline must pass the following control tests by a teacher:*
1) Must be reasonable (this is relative, as what is reasonable in one instance may not be in another).
2) Must be related to the gravity of the offence i.e not excessive.
3) Must not be administered with malice.
4) Its purpose must be defensible i.e not to inflict physical or internal injury on the pupil/student.
5) Must be related to the age, sex, size, mental, physical and emotional stage of development of the pupil/student.
*Forms of Discipline and Punishments in Classroom*
The following forms of punishments may be considered by the teacher:
1) Verbal warning
2) Simple Punishment
3) Isolation
4) Denial
5) Academic Punishment
6) Any other form of punishment that may be initiated by the teacher except *corporal* punishment.
*The use of cane is now getting outdated as it is considered a corporal punishment.*
*What is a Corporal Punishment?*
In a simple term, it is any punishment that causes physical and internal injury to the body of the pupil/student.
*Likely Factors to Consider Before Punishing a pupil/student*
1) The Age
2) Health Condition
3) Mental Fitness
4) Physical Fitness
Conclusively, in order to avoid parents harassment, police case and litigation, punishing a child should be professionally, diplomatically and reasonably done.
*Punishment Should be Corrective Not Vindictive...*
*Forewarned is forearmed.*

African road safety day
BRIEF PRESENTATION BY BOBOYE OYEYEMI, MFR, mni CORPS MARSHAL AND CHIEF EXECUTIVE, FEDERAL ROAD SAFETY CORPS AT THE COMMEMORATIVE SERVICE FOR THE 2014 AFRICA ROAD SAFETY DAY/ WORLD DAY OF REMEMBRANCE FOR ROAD TRAFFIC CRASH VICTIMS (WDR) HELD ON SUNDAY 16TH NOVEMBER, 2014.
PROTOCOL
The Africa Road Safety/ World Day of Remembrance for Road Traffic Crash Victims (WDR) was borne out of the resolutions attained in the event of the Africa Union Executive Council EX.CL. /Dec. 682 (XX) of January 2012 and the United Nations Resolution A/60/5 of 26 Oct. 2005.
The joint agreement seeks to identify with victims of road traffic crash and families as well as creating awareness through rallies and other events on the need to replicate best road practice and safety consciousness at all times.
The decision led to the adoption of the 3rd Sunday of November each year to commemorate those killed and injured on the world’s roads and share the grief with their families through reflections, the huge burden and cost of Road Traffic Crashes.
According to the World Health Organisation (WHO) report of 2012, Road Traffic Crash ranked the tenth (10th) leading causes of death the World over with over 1.3 million recorded in the past Decade and between 20 and 50 million sustaining serious injuries. Unfortunately, a large percentage of the victims of the crashes came from developing economies referred to as the third world countries.
The campaign to reduce the increasing rate of road traffic crashes (RTC) on our roads, should therefore, not be left in the hands of the Federal Road Safety Corps alone. The entire populace should rather be involved.
One of the major cause of road crashes that we have discovered is speed violation, which is a deliberate behavior by the driver who should know the risks involved but would decide to ignore the danger. Studies have shown that up to 90 percent of all licensed drivers violate the speed limit at some points in their driving career, with about 75 percent admitting to committing the offense regularly.
It is regrettable that all car drivers consider the consequences of speeding before making the decision to do so. But speed violation is not just speeding above 100 kilometer per hour, rather, every point of the road has its own specific speed limits, which must be observed, depending on the nature of the road.
Thus as one travels through the road, he passes through built up areas, schools, markets , bridges , and places of worship which require different speed limits. Safety conscious individuals must therefore take cognizance of these places.
For the avoidance of doubt, some of the commonest traits exhibited by road users which contribute to road traffic crashes with the attendant risk factors are;
Speeding
Drinking and driving under the influence of Alcohol.
Non use of Seat belts
Non use of Child restraints
Failure to use motorcycle helmets
Cell phone use and texting while driving;
Illegal diversion to construction sites.
Over loading of vehicles.
In line with the decisions of the African Union (AU) and the United Nation’s Resolution for the annual remembrance of victims of road traffic crashes, the third Sunday of November each year was set aside as the day. Accordingly, we have mapped out series of activities to mark the 2014 edition, as is being observed through this Church service today.
I therefore, urge all members of the congregation to endeavor to always incorporate enlightenment campaign in road safety as part of their schedule of programme of the Church. For road traffic crashes don’t just happen, they are caused either by our action or inactions and could therefore be prevented if traffic rules and regulations are well observed.
There is no wisdom in praying to God’s protection in the course of a journey in a vehicle whose drive operate with worn out tyres and cruising at a speed of 130km per hour. We must therefore, use the period of the remembrance day to caution road users to imbibe good road safety habits for everyone to arrive safely and reunite with their family and loved ones in one piece.
As part of measure to control speed at which vehicles travel on our highways, the FRSC will from 1st of June 2015 commence enforcement of compulsory use of speed limiting devices in all commercial vehicles nationwide. Thereafter the enforcement would be extended to all other categories of vehicles. As Nigeria aspires to become an economic giant as projected by Vision 20:2020, no responsible government would allow its productive sector to be wasted from seemingly avoidable road carnages caused by reckless driving behavior from excessive speeding.
We therefore enjoin all road users, including passengers to support this initiative, which is aimed at reducing deaths from speed related crashes in Nigeria by over 30 percent.
We appeal to our spiritual fathers to make the Road Safety message a priority in their sermon as road safety is a collective responsibility of all citizens.
While wishing all the brethren a memorable Christmas and safe motoring as we travel to celebrate the New Year with our loved ones, let us remember always to be road safety vanguards by constantly adhering to traffic rules and regulations.
May the Almighty God bless you all.

Ways of the wise road users
WAYS OF THE WISE ROAD USERS
Wise Road Users are attentive, alert and considerate to others. They do not blame circumstances, conditions for their behavior. They are not distracted by eating, smoking, and making or receiving call while driving.
Wise Road Users have a reality-seeking attitude. They know that defensive driving habit seem to go hand-in-hand with figuring out how the traffic rules and regulations operates and dictate what will happen under what conditions. So they seek for road traffic knowledge and wisdom.
Wise Road Users remain open-minded, flexible and receptive. They know that all explanation and reasons to bit deadline and meet-up schedules are all pointers to Road Traffic Crashes waiting to happen.
Wise Road Users are non-reactive while taking on the road, rather they are proactive people that recognize their responsibility. They do not lash out, if there is a traffic jam, wise road users will quickly adapt to that condition. Reactive Road Users are often affected by their physical environment. Wise Road Users accept the present moment from the Center of awareness, energy and goodness, and quiet joy.
Wise Road Users plan their journey if they must travel. They map out the route to travel, the time and the means of travel ahead of time, they do not give ride to strange passengers except on rescue mission for Road Traffic Victims.
Wise Road Users sees the Road Traffic environment holistically. The road, the environment and the driver. It is a system (that is, a whole that consists of interacting and interdependent components in a persisting pattern of relationship). The relationship that define this traffic system frequently capture out attention, we can see them directly. Unfortunately, these system relationships tend not to be as flashy or grubby. Wise Road Users recognize the relationship even though it may not be flashy.
Wise Road Users take notice of their relationships and cruise their way to safety.
Wise Road Users knows himself. He knows the condition of himself; he knows whether he can drive better with a corrective Glasses or not. He knows when to terminate his driving for day. He knows his strength and weakness and corrects them.
Reactive road users will always suspend what is supposed to be done now.
Wise Road Users are aware that the greatest challenge in life is thinking; and doing what ultimately matters and brings success, but when the head is off, bones fractured, property lost to Road Traffic Crash; it becomes impossible to do things that ultimately matter and bring success and happiness. So fasten your seat belt properly and adopt the ways of the Wise Road Users to avoid Road Traffic Crash.
